General terms and conditions 

General Terms and Conditions for the Sale and Brokerage of Tickets and Other Products and Services and for Attendance at Events ("Parallel World GTC")

We have changed our general terms and conditions. The following new General Terms and Conditions apply to the sale and brokerage of admission tickets and other products and services as well as the attendance of events ("Parallelwelt GTC") for all orders placed via Parallelwelt from 15.06.2021. 

1 Contractual basis

1.1 Validity of the Parallelwelt GTC. These General Terms and Conditions ("Parallelwelt GTC") govern

a) the sale of admission tickets or other access authorizations, e.g. wristbands, for various events ("Tickets") and other services and products via Birkwald und Goldau GbR, Rodenbergstr. 3, 10439 Berlin, (hereinafter referred to as "Parallelwelt"),

b) the sale of other products and services via partners for distribution, (you can recognize partners for distribution by the fact that they appear under their own name (both on the website and in the imprint), and the webshop is marked with the addition "powered by Parallelwelt" or a similar addition indicating the cooperation ("Partner for Distribution"); in this case, the terms and conditions of sale of the partner for distribution ("Distributor Terms and Conditions") also apply,

c) participation in events, insofar as the event organizer or a third party other than the event organizer sells the tickets ("Organizer") does not make its own event conditions the basis of the event contract ("Organizer GTC").

1.2 Validity of the Sales Partner GTC for ticket sales by sales partners

a) Purchase of tickets and other services. The purchase of tickets, other products or services through a sales partner of Parallelwelt is made on the basis of these Parallelwelt GTC, regardless of whether it is made by telephone or online. Additional sales partner GTC for the purchase of additional services or products shall apply in addition, as well as with priority in the event of contradictions.

b) Inclusion of the sales partner GTC. The sales partner GTC will be displayed or brought to your attention when you place your order. During the check-out process when ordering via the Internet, you will be asked to agree to the validity of the Distributor T&Cs.

1.3 Validity of the organizer GTCs

a) Execution of the events. The events are predominantly organized by other organizers and not by Parallelwelt. The contract to attend the event is concluded between the ticket purchaser and the event organizer on the basis of separate organizer GTC. In this respect, Parallelwelt only provides the opportunity to purchase tickets on behalf of or as a commission agent for the event organizer. The issuer of the ticket is the respective organizer.

b) Validity of the regulations for event attendance in section 9. The regulations for event attendance in section 9 of these Parallelwelt GTC only apply insofar as (i) the organizer does not provide its own organizer GTC to regulate the points in question; in the event of contradictions, the organizer GTC take precedence, or (ii) Parallelwelt itself acts as the organizer in the individual case; this is indicated separately when the tickets are purchased.

2 Registration and protection of the account

2.1 Registration of the Account. Each Ticket Purchaser is given the opportunity to register an account on Parallelwelt's website or apps. The Ticket Purchaser must keep his access data for the account protected from access by third parties and notify Parallelwelt immediately via the online contact form in the event of suspected unauthorized knowledge thereof.

2.2 Protection of the Account. The Ticket Purchaser shall remain logged into the Account on the Website, if applicable, after accepting corresponding cookies; in the event that his end devices are used by other persons, the Ticket Purchaser shall be responsible for their actions in this connection, insofar as he is responsible for this.

2.3 Blocking of the account. Parallelwelt is entitled to temporarily block the Ticket Purchaser's Account or parts thereof if there are concrete indications that the Ticket Purchaser has violated sections 33.6 (maximum number of purchases), 6.2 (personalized tickets) or 6. 5 (prohibition of commercial use) of these Parallel World GTC or section 3 of the Terms of Use for Websites and Apps (Terms of Use) or if there is reasonable suspicion in this respect, or if there is any other justified interest in blocking, e.g. in the event of suspected misuse by unauthorized third parties. If, after consideration of the legitimate interests of the Ticket Purchaser and third parties, the blocking cannot be lifted, Parallelwelt is entitled, at its discretion, to permanently block or delete access and the content of the account in whole or in part.

2.4 Term of account use. The contract for the use of the Account runs for an indefinite period of time and may be terminated by the Ticket Purchaser at any time without notice. Termination may be effected by deleting the account or by sending an e-mail to tickets@Parallelwelt.net. Parallelwelt may terminate the contract by giving four weeks' notice, in particular if the account has not been used for more than one year. The right to terminate without notice in the event of a violation of applicable law, these Parallelwelt GTC or the Terms of Use remains unaffected.

 

3 Conclusion of the contract

3.1 Details of events. With the exception of Parallelwelt's own events, the information on the events contained on the website and in other announcements, in particular the event location, the start of the event or the content of the event, is provided by the respective organizers or other third parties (hereinafter collectively referred to as "organizer information") without Parallelwelt being able to verify this information. The contractual offer shall be submitted on this basis.

3.2 Hall and location plans of the venue. The hall or site plans of the venue that may be displayed for the purpose of selecting a seat in the ordering process are for orientation purposes only and do not represent a true-to-scale representation of the venue.

3.3 Corrections. The Buyer shall bear the risk for the correct entry or specification of information in the ordering process, in particular with regard to the selection of the event, venue, date and seat.

3.4 Ticket orders from the age of 18 or with the consent of the legal representative. The purchase of tickets, products and other services is only permitted to persons who are at least 18 years old and have unrestricted legal capacity or with the consent of their legal representative.

3.5 Acceptance of the contract offer. The contract between the buyer and the seller (usually the respective event organizer; if Parallelwelt sells the tickets on behalf of the event organizer as a commission agent, Parallelwelt shall be the seller of the tickets) shall be concluded by Parallelwelt's acceptance of a purchase offer by sending an order number and shall be subject to the condition precedent of full payment in due time; exceptions to this are purchases where the buyer uses a payment service, such as purchase on account. In these cases, the contract is concluded when the order number is sent. In the case of payment on account, Parallelwelt assigns the payment claim against the Buyer to the provider of the selected payment method; in this respect, the General Terms and Conditions of the respective payment method provider, to which reference is made in the ordering process, shall apply in addition.

3.6 Purchase restrictions. In order to make unfair ticket trading more difficult, the purchase of tickets per purchaser is limited to a maximum number, which varies depending on the event and is communicated in the order process. If the maximum number is exceeded by the buyer, Parallelwelt reserves the right to block the tickets exceeding the maximum number for admission.

4 Payment, Delivery

4.1 Payment

a) Prices. When purchasing tickets or other products, service and shipping costs as well as - to the extent permitted by law - fees for the use of selected payment methods will be charged by Parallelwelt (hereinafter collectively referred to as "Fees"), which may vary depending on the event. These additional fees will be communicated to the Buyer during the ordering process. Ticket prices and fees include the statutory value added tax.
b) Due date and collection of receivables. The purchase price and fees are due for payment upon conclusion of the contract - within 3 working days in the case of bank transfer.

c) Payment of additional services. If the purchaser purchases optional additional services such as gift wrapping, fan guarantees and insurance, the costs for these will be invoiced to him together with the ticket price and fees.

4.2 Delivery. Tickets or other products will be delivered by the method of shipment chosen by the Ticket Purchaser after the conclusion of the contract, i.e. after full payment of the Ticket price and fees within the specified delivery period. In order to receive information about your purchase, please contact us or the respective partner for distribution, which you can find in the order confirmation, stating the order number, which has been communicated to you after completion of your order.

 

5. right of withdrawal

5.1 No right of revocation for the purchase of tickets. Insofar as Parallelwelt sells tickets for its own or third-party events, regardless of whether the sale of the tickets is brokered for the event organizer or Parallelwelt acts as a commission agent in its own name, in connection with leisure activities, there is no right of revocation pursuant to § 312g para. 2 no. 9 BGB.

5.2 Rights of revocation when purchasing supplementary services through partners for distribution. Information on the existence of rights of withdrawal when purchasing supplementary services through partners for distribution, including information on the existence of rights of withdrawal when purchasing goods from partners for distribution in combination with tickets, can be found in the sales partner GTC.

5.3 No right of cancellation for contracts for the delivery of sound or video recordings or computer software. Pursuant to Section 312g (2) No. 6 of the German Civil Code (BGB), there shall be no right of revocation for contracts for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
5.4 Right of withdrawal for downloads. In the case of contracts for the delivery of download products, Parallelwelt shall inform the Buyer as part of the order that the contract will commence with his consent before the expiry of the cancellation period as soon as the Buyer starts the download, and that the Buyer's consent will cause him to lose his right of cancellation upon commencement of the execution of the contract.

5.5 Rights of withdrawal in case of combined purchase of goods and tickets. In the event of the purchase of goods or products other than those mentioned in Clauses 5.2, 5.3 and 5.4 together with tickets under a uniform contract, so-called bundles or combined items, the right of revocation may only be exercised uniformly. In this case, the Buyer shall have a right of revocation for the entire contract.

5.6 Right of revocation for the purchase of goods. When purchasing other goods, e.g. merchandise products without tickets, the buyer has the right to revoke the purchase contract with Parallelwelt or - in the case of mediation of purchase contracts with third parties - the purchase contract with the third party within 14 days after receipt of the goods.


CANCELLATION POLICY

To exercise your right of withdrawal, please contact tickets@parallelwelt.net and give us a clear statement of your decision to withdraw from this contract. A statement of reasons is not required. You can use the enclosed sample revocation form for this purpose, which is, however, not mandatory. In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

In the event of such a revocation, Parallelwelt is obligated to repay you the purchase price of the goods (plus the postage costs for the original delivery, with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us) without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to your handling the goods in a way that is not necessary for the inspection of the condition, properties and functioning of the goods.

END OF THE CANCELLATION POLICY

6. tickets

6.1 General. With the purchase of a ticket, the buyer receives the right to attend the event designated on the ticket. After receipt, tickets must be kept in a safe place and protected from damaging influences such as direct sunlight, heat or moisture, as illegibility of the information on the ticket, which is important for admission control, can lead to the invalidity of the ticket and thus to the loss of the right of admission.

6.2 Personalized tickets. The ticket is personalized during the ordering process (even without the name printed on it). The organizer, as issuer of the ticket, does not wish to grant access to the respective event to every ticket holder, but, in the case of tickets brokered via Parallelwelt, only to those ticket holders who have purchased the tickets from Parallelwelt or in the context of a permissible transfer pursuant to Section 6.6. If a contracting party has permissibly acquired several visitation rights from us for itself and for third parties within the framework of a visitor contract, the transfer shall be effected by the contracting party permissibly assigning these visitation rights to several third parties and by entering into separate visitor contracts with the entering persons in each case, assuming all rights and obligations and only in compliance with all requirements of Clause 6.6. If tickets are personalized by being named on the ticket, the following shall apply:a) Individual personalization. For individually personalized tickets, identification is mandatory at the entrance. Admission is granted only to the person named on the ticket, provided that he or she can prove his or her identity at the entrance by means of a valid personal document, a valid driver's license or another means of proof agreed upon with the organizer. If the Organizer offers the possibility to personalize the tickets individually at the time of purchase, the Purchaser shall be requested during the ordering process and shall be obliged to truthfully state the first and last names of the additional persons for whom the personalized tickets are to be issued when placing the order.

b) Buyer personalization. When purchasing multiple Tickets, which are automatically personalized to the Buyer's name, all Tickets shall be issued in the Buyer's name ("Buyer-Personalized Tickets"). Admission to the event under presentation of a buyer-personalized ticket, which is not issued in the name of the visitor seeking admission, is only possible for the visitor in the presence of the person named on the ticket, if the visitor can identify himself/herself at the entrance by means of a valid personal document, a valid driver's license or another means of proof agreed upon with the organizer. The holder of the right to visit the event is the purchaser, who is, however, entitled to visit the event in company, whereby a separate ticket personalized to the purchaser's name is required for each accompanying person.c) No obligation to check identity. The organizer is not obliged to check identity at the entrance. He shall also be released from his obligation to perform vis-à-vis the purchaser if he grants access to the event to another person upon presentation of the personalized ticket.

d) Misuse of third party data. The misuse of third party data in the purchase of personalized tickets without their declared or presumed intention may lead to blocking. Further details are set out in Section 8.

e) Re-personalization. Re-personalization of tickets is only possible in accordance with the organizer's terms and conditions, which will be communicated to you at the time of purchase, and only if the purchaser requests re-personalization from Parallelwelt or, in the case of purchase through a sales partner, from the organizer, stating the event data, order number, order data (e.g. date of order and means of payment used) as well as the name of the visitor originally noted on the ticket and the name of the new visitor. With the change of personalization, the originally named person loses the right to visit the event. The change of personalization can only be made no later than 6 (six) hours before the start of admission to the booked event. Further details are regulated by the conditions stated at the time of purchase as well as the organizer's GTC.

6.4 Blocking of tickets

a) Lost and stolen tickets. If tickets are reported as lost or stolen to Parallelwelt or the distribution partner through which the tickets were purchased, they may be blocked in accordance with the organizer's GTC with the result that the right to attend the event expires.

b) Tickets acquired or used improperly. Tickets purchased in violation of clauses 3.6 (Maximum number at purchase), 6.2 (Personalized tickets), 6.5 (Prohibition of commercial and industrial resale or use) or 6. 6(a) (Permitted transfer) or (b) (Ticket transfer) of these Parallel World GTC or for which there are reasonable grounds to believe that they are to be used in such a manner, may be blocked by the organizer after taking into account the interests of the purchaser, with the consequence that the right to gain access to the event expires. There will be no refund of the purchase price or fees. Parallelwelt is entitled to prove a higher damage, the buyer is entitled to prove a lower damage.

6.5 No use of tickets for commercial or business purposes; unauthorized transfer. Tickets are sold exclusively for private, non-commercial use. Any commercial or business resale of tickets is prohibited. The commercial sale of tickets is reserved exclusively for the respective event organizer and the advance booking offices authorized by the event organizer. In particular, it is not permitted to (a) publicly offer tickets for sale in an auction (e.g. (b) to offer or sell tickets on Viagogo, StubHub, Ticketbande, (c) to offer or pass on tickets at a higher price than the price paid, whereby a price surcharge of a maximum of 15% is permitted to compensate for transaction costs, (d) to sell or pass on tickets to commercial resellers and/or ticket dealers, (e) to use or have used tickets commercially or commercially, e.g. for raffle purposes, without the prior written consent of the organizer. e.g., for raffle purposes, for purposes of advertising, marketing, as a promotional gift, or as part of an unauthorized hospitality or travel package. Passing on tickets without including these Parallelwelt GTC is not permitted. Parallelwelt or the respective partner for distribution reserves the right to block your account on the website or the tickets in accordance with section 6.4 or to no longer accept further ticket orders. This also applies in cases where there is reasonable suspicion that you have used or will use automated programs to order tickets or have ordered tickets in excess of the permitted maximum number per person. Subject to the imposition of a contractual penalty pursuant to Section 6.7, a violation of the provisions of this paragraph shall result in the loss of the access authorization without compensation, i.e. the ticket shall lose its validity in this case.

6.6 Permissible transfer

a) Principle. A private transfer of a ticket for non-commercial reasons, in particular in individual cases in the event of illness or other prevention of the customer, is permitted, provided that there is no case of inadmissible transfer within the meaning of Section 6.5. In this case, the Customer may transfer the rights and obligations arising from the Visitor Contract to a third party only by the third party entering into the Visitor Contract in its place, assuming all rights and obligations. This entry requires the consent of the seller, which is hereby granted under the following conditions: (i) the transfer is a case of permissible transfer as described above in this section 6.6(a) as well as 6.6(b), (ii) the customer expressly informs the new ticket holder of the validity and content of these GTC and the new ticket holder agrees to the validity of these GTC between him and the seller (i.e. the organizer or Parallel World - see section 3.5 above). The transfer of individual rights under the Visitor Contract is excluded in the absence of any of the conditions set forth in (i) or (ii) above.

b) "Ticket Transfer". (i) For many events, Parallelwelt offers the option to transfer tickets ("Ticket Transfer"). If the Ticket Transfer option is offered for a Ticket, the Customer may transfer corresponding Tickets to friends and family by logging into his Parallelwelt customer account and following the instructions there.
(ii) Ticket Transfer should only be used for a transfer to people who are trusted. Section 6.6(a) applies to permissible resale of Tickets to other third parties.
(iii) When transferring Tickets using Ticket Transfer, Customer transfers only the right to visit to the receiving person. The purchase contract and all related rights and obligations remain unchanged between the original purchaser of the ticket and the seller (see section 3.5 above). This applies regardless of how often the ticket is transferred by means of ticket transfer. Irrespective of this, the terms and conditions relating to the use of the Ticket shall continue to apply even in the event of multiple transfers by means of Ticket Transfer.
(iv) Ticket transfer can only be used for Tickets, but not for so-called Upsells that were purchased with the Ticket or other components of a Package Offer that are not Tickets.
(v) The Customer may withdraw the offer to transfer a Ticket to the third party by means of Ticket Transfer, unless the third party has already accepted such Ticket Transfer offer.
(vi) IMPORTANT: Once a Recipient has accepted the Ticket Transfer Offer, (1) the original Ticket will no longer entitle Customer to admission to the applicable Event; (2) the Recipient will receive a new Ticket with a new barcode, and therefore, without prejudice to any legal rights, Customer may not cancel or otherwise reclaim its original Ticket; (3) Customer may no longer use the Parallel World Fan Guarantee for such Ticket; and (4) Customer may not otherwise transfer the Ticket to another person. If a Ticket is transferred multiple times via Ticket Transfer, only the Ticket created for the last recipient after the Ticket Transfer will be entitled to admission. All previous barcodes will be cancelled.
(vi) If an Event is cancelled, postponed or otherwise materially affected, only the original Ticket purchaser of a Ticket transferred via Ticket Transfer will be entitled to a refund or other credit pursuant to Section 8.4 below. Parallelwelt will conduct event- or ticket-related communications with the original Ticket Purchaser. The latter is obligated to keep the recipients of a Ticket transferred by means of Ticket transfer informed of all relevant information that we make available to him.

6.7 Contractual penalty

a) Conditions: In the event of a culpable breach of one or more of the provisions in Clauses 6.5, 6.6 (a) or (b), the Seller (Clause 3.5) shall be entitled, in addition to the other measures and sanctions possible under these Parallel World GTC and any claims for damages, to impose on the respective customer a contractual penalty to be determined by the Seller at its reasonable discretion (Section 315 BGB), the appropriateness of which may be reviewed by the competent court in the event of a dispute.

b) Amount: The amount of the contractual penalty shall be determined in particular by the number and intensity of the violations, the type and degree of fault (intent or negligence), the efforts and successes of the customer or ticket holder with regard to making good the damage, the question of whether and to what extent the customer is a repeat offender, and, in the case of unauthorized resale of tickets, the number of tickets offered, sold, passed on or used, as well as any proceeds or profits generated by the resale.

7. obligations of Parallelwelt with regard to third-party events

7.1 Information on Parallelwelt's liability for third-party events. Parallelwelt is not responsible for the performance, changes in time and place of performance or cancellations of third-party events.

7.2 Information on the event. Insofar as Parallelwelt merely brokers tickets in the name of and on behalf of the event organizer or sells them on commission, Parallelwelt has no possibility to influence information about events, in particular event dates and venues, performing artists, content of the program, allocation of price categories or seating or standing room availability, or to check such information completely. In this respect, Parallelwelt acts with due diligence within the bounds of what is possible and contractually permissible vis-à-vis the event organizers. Parallelwelt assumes no liability for the correctness and completeness of such information outside its sphere of influence. This extends to the careful compilation and timely dissemination of information, but not to the issuance of timely notices of cancellation by the organizer.

7.3 Buyer's obligation to check event changes or cancellations. It is the Buyer's responsibility to check the unchanged taking place of the event, especially on the day of the event, by the information issued by the organizer himself and to take for this purpose especially the Internet offer of the organizer, the performing artist, as well as other generally accessible sources including press and radio.

8 Warranty, Refund and Liability

8.1 Warranty. For product purchases, the buyer is entitled to the statutory warranty rights in case of defects.

8.2 Refund for personalized tickets. If the organizer allows the cancellation of personalized tickets in accordance with the terms and conditions of sale, a refund will only be made if this is cancelled with Parallelwelt or the partner for distribution from whom it was purchased within the cancellation period specified at the time of purchase. In all other cases of personalization, a refund is not possible. Parallelwelt is allowed to prove a higher damage and the ticket purchaser is allowed to prove a lower damage.

8.3 Changes to the content of events. Organizers may change the program if special occurrences or events beyond the Organizer's control make this necessary. In this case, there is no claim to exchange of tickets or refund of the ticket price, as far as the change is insignificant. Section 8.4 (b) remains unaffected.

8.4 Cancellation, termination or rescheduling of events. (a) In the event of cancellation or postponement of events for which the organizer is responsible, as well as in the event of other occurrences that give rise to claims against the organizer, the Ticket Purchaser's claim shall only be against the organizer or Parallelwelt, insofar as Parallelwelt sells the tickets as a commission agent, and shall be limited to reimbursement of the nominal value of the ticket. Travel and accommodation expenses will not be reimbursed. Clause 8.7 remains unaffected. (b) If an event is cancelled, interrupted or postponed due to a circumstance for which the organizer is not responsible (e.g. force majeure), the visitor's right to withdraw from the contract is excluded. In the event of cancellation or discontinuation, the organizer will make up for the event as far and as soon as possible and reasonable. If the event is postponed or - in case of cancellation or termination - made up for, the tickets for the event shall remain valid.

8.5 Refund on the instructions of the organizer. If Parallelwelt has been instructed by the respective event organizer to refund the ticket price in the name of and for the account of the event organizer, Parallelwelt shall make the refund on behalf of the event organizer; Parallelwelt shall not have any refund claims of its own against Parallelwelt insofar as Parallelwelt is not the seller of the tickets. The refund includes the printed ticket price and is made exclusively to the original ticket purchaser. The refund conditions for concert cancellations apply to refunds in the event of a concert cancellation.

8.6 Refund in case of insolvency or inability to pay of the organizer. Due to insolvency law regulations, Parallelwelt is not permitted to refund the Ticket price to the Ticket Purchaser in the event of the insolvency or inability to pay of the promoter. In this case, the refund shall be made exclusively directly by the Organizer.

8.7 Liability

a) Unlimited liability. Parallelwelt, its legal representatives, executives or vicarious agents shall be liable without limitation in accordance with the statutory provisions of the Federal Republic of Germany (i) for damages resulting from injury to life, body or health, (ii) in the event of intent or gross negligence, (iii) in accordance with the Product Liability Act and (iv) in the event of the assumption of guarantees.

b) Limited Liability. For slight negligence, Parallelwelt, its legal representatives, officers or agents shall only be liable in the event of a breach of a "material" obligation under these Parallelwelt T&C. "Essential" obligations are those that are necessary in each case for the fulfillment of the contract for the sale of tickets and the staging of its own events, the breach of which would jeopardize the achievement of the purpose of the contract, and compliance with which the ticket purchaser may therefore regularly rely on. In these cases, liability is limited to typical and foreseeable damages.

8.8 Release from claims. Insofar as the Ticket Purchaser is at fault, the Ticket Purchaser shall indemnify Parallelwelt against all claims asserted against Parallelwelt by third parties due to the conduct of the Ticket Purchaser in connection with the purchase of tickets or the staging of Parallelwelt's own events and shall bear the legal defense costs incurred in this respect in the statutory amount. In the event of a claim by a third party, the ticket purchaser is obligated to immediately provide Parallelwelt with truthful and complete information that is necessary for the examination of the claims and a defense.

9. regulations for the attendance of events

9.1 Applicability. The following terms and conditions for the attendance of events apply to all events, unless an event organizer agrees with the ticket purchaser on the application of separate organizer GTC.

9.2 Admission to and participation in events. When attending an event, the rules and regulations of the event organizer and the venue (hereinafter collectively referred to as "Rules of Conduct") must be observed. Rules of conduct also result in particular from the house rules of the respective venue, notices there, instructions from service personnel or announcements. A violation of the Rules of Conduct or unacceptable behavior that is likely to cause disruptions in the course of the event, damage to the venue, safety devices or stage equipment, or cause a significant nuisance or infringement of the rights of others, entitles the organizer to expel the visitor from the venue. The same applies to refusal of admission.

9.3 Admission controls. The deployed security personnel may carry out searches of persons and carried bags etc. at the entrance to a venue in order to ensure the safety of visitors or compliance with the rules of conduct.

9.4 Image and sound recordings by the event organizer. Parallelwelt points out that image and sound recordings are made at events and that visitors, as part of the audience, may be affected by this. It is the visitor's responsibility to inform himself/herself about the making of such recordings before purchasing the ticket from the event organizer.

9.5 Image and sound recordings by visitors. The rights to make and use image and sound recordings are governed by the organizer's General Terms and Conditions. The making of recordings for other than purely private purposes shall in any case require the prior written consent of the organizer. The deletion or destruction of corresponding recordings can be demanded.

9.6 Carrying objects, animals, food or drinks. The use of lasers or cell phones may be prohibited, as may the carrying of animals with the exception of guide dogs. The same may apply to food or beverages. It is the responsibility of the ticket purchaser to inquire about such restrictions with the organizer or the venue before purchasing the ticket.

9.7 Late arrival. Latecomers have no right to be admitted immediately. The Organizer will attempt to admit late arrivals at a convenient time that does not disrupt the performance, such as during an intermission.

9.8 Leaving the Venue Early. In case of leaving the venue before the end of the event, re-admission may be denied

10. special regulations for events on the occasion of Covid-19.

 

10.1 Contact Tracking Data as an Admission Requirement. For your safety and the safety of other event attendees, the organizer of an event may collect certain data from individuals attending the event (e.g., first name, last name, phone number, and/or well-being information, hereinafter referred to as "contact tracing data") to enable contact tracing and prevent the spread of Covid-19. It is a condition of entry that all ticket holders who wish to attend such event provide Contact Tracking Data when requested to do so. By purchasing the ticket, the purchaser agrees to provide complete and truthful information to the event organizer in a timely manner via the means we provide (e.g., an online form or via a check-in desk at the event). Parallel World will contact the Buyer in a timely manner, informing if the Event Organizer requires contact tracing data for the Event and how and when such data must be provided. Contact tracing data will be collected and processed in accordance with the data protection policy of the respective organizer.

10.2 If a Ticket Holder who wishes to attend an Event for which the provision of data pursuant to section 10.1 is required breaches the obligation in section. 10.1, the Event Organizer shall be entitled to deny such Ticket Holder admission without entitling the Ticket Holder to a refund of the ticket price.

10.3 In the event that a purchaser intends to sell or otherwise pass on a ticket for an event where participants are required to provide contact tracing data, these Parallel World GTC must be agreed to by the third party as part of the passing on, in particular the requirement for the participant to provide complete and truthful contact tracing data in a timely manner through the means provided.

11. final provisions

11.1 Ineffectiveness of provisions. The invalidity of individual provisions shall not affect the validity of the remaining provisions.

11.2 Applicable law. The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of German private international law (IPR) and the UN Convention on Contracts for the International Sale of Goods (CISG).

11.3 Place of performance and jurisdiction. The sole place of performance for deliveries, services and payments shall be Berlin, provided that the Ticket Purchaser is an entrepreneur within the meaning of § 14 of the German Civil Code (BGB). If the Ticket Purchaser is an entrepreneur, Berlin shall be the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. In the case of cross-border contracts, this also applies to consumers; in this case, Parallelwelt GmbH reserves the right to invoke any other internationally competent court.

11.4 Online dispute resolution. The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at www.ec.europa.eu/consumers/odr. The e-mail address of Parallelwelt is info[at]Parallelwelt.de. Parallelwelt is neither obliged nor willing to participate in the dispute resolution procedure.

11.5 Transfer of rights. Parallelwelt is entitled to transfer rights and obligations arising from this contractual relationship in whole or in part to a third party with a notice period of four weeks.
